The visual appearance of software and the contents of these pages (including but not limited to text, images, and audio-visual elements) are copyright of CG Drives and Automation (or its subsidiaries where so indicated and/or its licensors) and protected by copyright in Sweden and under various foreign laws and treaties. The content is also protected by unregistered community design. All rights reserved.

The contents of the software, including but not limited to, text, images and sound, may not, except for strictly private purposes or where otherwise indicated, be reproduced, transferred, distributed or stored without prior written permission by CG Drives and Automation.

Modifications to the contents of the software are expressly prohibited. Therefore, you may not, for instance:

1. Distribute or transmit any such contents on or off line;
2. Modify, reuse or repost any such contents;
3. Remove any notations on downloaded materials which constitute notice or explanation of copyright, trademark, trade dress, patent or other intellectual property rights;
4. Use such contents for any public purpose, even if non-commercial; or
5. Attempt to decompile, reverse-engineer or otherwise disassemble any software or other contents.

Trademark rights

All names, logos and trademarks are the property of CG Drives and Automation, its affiliates, related companies or its licensors or joint venture partners. CG Drives and Automation’s trademarks and brand names may be used only in accordance with the use permitted according to this Legal Statement or with the prior permission from CG Drives and Automation.

Any use of CG Drives and Automation’s trademarks in the advertising and promotion of CG Drives and Automation’s products requires proper acknowledgement.

No liability, warranties

The contents of CG Drives and Automation’s software are provided “as is” and “as available”. Except as required by applicable law no warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement, is made in relation to the correctness, accuracy, performance, reliability or otherwise of the software. CG Drives and Automation does not warrant that the server that makes it available are free of viruses or other harmful components. Any CG Drives and Automation software may include technical inaccuracies or typographical errors. Changes and additions may be made by CG Drives and Automation to any part of software herein. CG Drives and Automation reserves the right to revise the features available or withdraw access to them at any time.

CG Drives and Automation will not be liable in any manner neither for inferior internet response time of the end user access network nor for connectivity loss between mobile device and Drive or network service. CG Drives and Automation will not be liable in any manner whatsoever for any damages, including but not limited to direct, incidental, consequential, indirect, secondary, special, or punitive damages, losses or expenses or loss of profits related to accessing by you of CG Drives and Automation software or any site linked thereto, or the inability to use the functionality of these software, or use or attempted use of information contained therein or related to any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if CG Drives and Automation or its representatives are advised of such damages, losses or expenses. In no event will CG Drives and Automation damages exceed the cost, if any, paid by you for access to this software.

User Submissions

Any material, information or other communications you transmit or post on this software will be considered non-confidential, non-exclusive, royalty-free, irrevocable, fully sub licensable and non-proprietary (“communications”). CG Drives and Automation will have no obligations concerning the communication.

CG Drives and Automation will be free to disclose copy, distribute, incorporate and/or otherwise use the communications, together with all data, images, sounds, text, and other things embodied therein, for any and all commercial or non-commercial purposes.

You acknowledge and accept that CG Drives and Automation has the right to collect information and parameters regarding the Drive equipment and/or resulting from use of software including but not limited to electrical serial number, type of the drive, Drive firmware version, Drive parameters, fault codes, and locations of registration or use. We can use this information to better understand users’ behaviour and to further improve our product offering.

You also undertake that you are fully aware and solely take responsibility of the consequences and risk involved in using this software product to view or control Drives produced by CG Drives and Automation especially, but not limited to, when Drives can be controlled by this software as well as from operator panel of Drive at the same time or when performance of the software product can be affected by its operating hardware system and its surrounding. You are alone responsible and/or liable for any changes, modifications or any other actions which you make to Drives Equipment by using Application or Software and they are exclusively and solely at your risk and liability. CG Drives and Automation has no liability or responsibility for any of your actions or inactions made by using Application or Software related to the Drives Equipment and any such CG Drives and Automation’s liability is expressly waived of by you.

If you have an account, we may share the information submitted under your account among all of our services as well as our distributors and third party channel companies to the extent necessary to serve you better and to improve the quality of our services. We will not disclose your account information to other people or non-affiliated companies, except in the limited circumstances or with your consent. We may store and process personal information collected through our software in any country in which CG Drives and Automation or our partners maintain facilities. By using our services, you consent to the transfer of your information among these facilities, including those located outside your country.

You may also through this software give your acceptance to avail the remote assistance support. The content and terms of such remote assistance and support may include but not be limited to getting access to Customer’s Drive Equipment through internet connection to assist the Customer with modifying parameters and/or supporting the Customer otherwise. Getting access to the Drives Equipment is always subject to Customer specifically allowing CG Drives and Automation to get remote access to the device for which the Customer has downloaded the Application.

In case you submit personal data in this software or otherwise to CG Drives and Automation, you hereby consent to CG Drives and Automation´s use of such data for the purposes of evaluating your information and market CG Drives and Automation´s products and services, including a right to transfer the data to third countries and post information on Internet. CG Drives and Automation will be responsible under Swedish Law for such processing of personal data and you can contact CG Drives and Automation in case of incorrect data or other issues related to the personal data.

You acknowledge that you are responsible for handling all user account data, device id and passwords confidentially and will refrain from disclosing them to unauthorized third parties. You will also retain adequate virus protection software and data security software and maintain adequate software and processes to prevent any computer/device hacking or other malicious software attacks. You will also be responsible for any internet, WiFi, Ble-Comm. and other connections related to or between your devices and Application, Software and/or Drive Equipment.
